In the event of a conflict, the more specific agreement controls.

3. Eligibility

By using this website or purchasing from Conchords, you represent that:

  • You are at least 18 years old

  • You have the legal capacity to enter into binding agreements

  • You are using the products or services for lawful purposes

4. Digital Products

All digital products are provided under a license, not sold.

Use of digital products is governed by the Digital Product License Agreement, including restrictions on redistribution, resale, and sharing.

All sales of digital products are final unless otherwise stated.

Subscription-based content is provided for online access only unless explicitly stated otherwise.

Subscribers are granted conditional access rights. Content may not be downloaded, reproduced, redistributed, shared, resold, or republished in any form.

Unauthorized copying, extraction, or redistribution of subscription content may result in immediate termination without refund.

Subscription content may be used solely for the subscriber’s internal business operations and may not be repackaged, resold, sublicensed, or incorporated into competing commercial offerings.

5. Services

Services are provided on a project or engagement basis only.

Details regarding scope, deliverables, timelines, and fees will be outlined in a written proposal, invoice, or agreement.

Conchords does not provide ongoing services, monitoring, maintenance, or support unless expressly agreed in writing.

6. Payments and Refunds

Pricing, payment terms, and accepted payment methods are displayed at the point of purchase or engagement.

Unless otherwise stated in writing:

  • Digital product purchases are non-refundable

  • Service fees are non-refundable once work has commenced

Failure to make timely payment may result in suspension or termination of access or services.

Cancellation of a subscription prevents future billing but does not retroactively refund prior payments. Access remains available until the end of the active billing period.

You agree not to initiate chargebacks or payment disputes without first contacting Conchords to attempt resolution. Unauthorized chargebacks may result in immediate termination of access and additional recovery efforts.

6A. Subscription Membership Access

The Business Automation Architect Vault and any other subscription-based offerings are provided on a recurring subscription basis.

By purchasing a subscription:

  • You are granted limited, non-transferable access to member-only digital content.

  • Access remains active only while subscription payments are current.

  • Access is revoked upon cancellation, failed payment, or termination.

Subscriptions renew automatically at the selected billing interval unless canceled prior to the next billing date.

Conchords does not guarantee permanent access to any subscription-based content.

Subscription access constitutes a limited license to view and utilize content for internal business use only and does not transfer ownership of any materials.

Conchords reserves the right to modify, update, replace, or remove subscription content at any time without prior notice.

7. No Guarantees

Conchords makes no guarantees regarding:

  • Business results or outcomes

  • Revenue, savings, or performance improvements

  • Suitability for any specific purpose

All content, products, and services are provided on an “as is” basis.

Nothing provided through the website, digital products, subscription content, or services constitutes legal, financial, tax, or professional advice.

8. Intellectual Property

All content, branding, materials, frameworks, and systems on this website are the intellectual property of Conchords unless otherwise stated.

You may not copy, reproduce, distribute, or exploit any content without prior written permission.

Membership access is individual and may not be shared, transferred, sublicensed, or assigned to another party.

9. Prohibited Conduct

You agree not to:

  • Use the website or products for unlawful purposes

  • Attempt to reverse engineer or misuse systems or materials

  • Circumvent access controls or licensing restrictions

  • Interfere with website security or functionality

  • Attempt to scrape, extract, copy, reproduce, archive, or systematically download subscription content for redistribution or commercial replication.

Violation may result in termination of access without refund.

10. Third-Party Tools and Links

Conchords may reference or link to third-party tools, platforms, or services.

We do not control or guarantee third-party services and are not responsible for their availability, performance, or policies.

11. Limitation of Liability

To the fullest extent permitted by law, Conchords shall not be liable for any indirect, incidental, consequential, or special damages arising from:

  • Use or inability to use the website

  • Digital products or services

  • Third-party tools or platforms

Total liability shall not exceed the amount paid to Conchords for the applicable product or service.

12. Indemnification

You agree to indemnify and hold harmless Conchords from any claims, losses, or liabilities arising from:

  • Your use or misuse of products or services

  • Violation of these Terms

  • Violation of any law or third-party rights

13. Termination

Conchords reserves the right to suspend or terminate access at its sole discretion for suspected violations, abuse, or misuse of subscription content.

Termination does not relieve you of payment obligations incurred prior to termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict-of-law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms, the website, or any products or services shall be resolved through binding arbitration conducted in the State of Wisconsin on an individual basis.

You agree to waive any right to participate in class actions, class arbitrations, or representative proceedings.

Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Conchords reserves the right to update or modify these Terms at any time.
